These Terms of Service ("Terms") govern your access to and use of the CaloriePilot website, mobile application, and related services (collectively, the "Service"). In these Terms, "CaloriePilot," "we," or "us" refers to the CaloriePilot service and its operator. Our current contact address is .
By creating an account, selecting the acceptance control presented in the application, or using the Service after being given notice of these Terms, you agree to them and to the Privacy Policy. If you do not agree, do not create an account or use the Service. Where the application asks you to accept a current version, the acceptance is recorded with that version and the time of acceptance.
1. Eligibility
You may use the Service only if you are legally able to enter into these Terms in your location. The Service is not directed to children. If local law requires a parent or guardian to authorize use, that authorization must be obtained before use. You are responsible for complying with the laws that apply to you.
2. The Service
CaloriePilot provides tools for nutrition logging, food and meal records, body data tracking, image recognition, AI-assisted parsing, summaries, personalized tools, and related support. Features may vary by platform, location, account status, subscription, or technical availability. We may add, change, suspend, or remove features for product, reliability, security, legal, or operational reasons.
The Service is not an emergency service and is not a substitute for a physician, dietitian, therapist, pharmacist, or other qualified professional. AI and image- recognition output may be incomplete, inaccurate, delayed, or unsuitable for you. It is provided for nutrition logging and general health-management reference, not for diagnosis, treatment, prevention, or other medical decisions. Do not rely on the Service for allergies, pregnancy, medication interactions, eating disorders, or urgent health decisions without qualified professional advice.
3. Accounts and security
You must provide information that is accurate and keep it current. You are responsible for protecting your password, email account, social-login access, device, and verification codes. Do not share credentials or allow another person to use your account. Tell us promptly if you suspect unauthorized access. We may require reauthentication for sensitive actions, including account deletion or privacy requests.
4. Your content
You retain whatever rights you have in the text, images, records, feedback, and other material you submit to the Service ("User Content"). You represent that you have the rights and permissions needed to submit it and to let us process it as described in these Terms and the Privacy Policy.
You grant CaloriePilot a limited, non-exclusive, worldwide license to host, store, reproduce, transform, transmit, and otherwise process User Content only as reasonably necessary to provide, secure, troubleshoot, and operate the Service, respond to your requests, and comply with law. This license ends when the relevant content is deleted, except for restricted copies that must be retained for legal, security, backup, or dispute purposes. We do not use User Content to publish your identity or sell it for advertising.
5. Acceptable use
You may not:
- break the law, infringe another person's rights, or submit content unlawfully;
- access another person's account or data, evade authentication, or test security without permission;
- interfere with the Service, introduce malware, scrape at scale, or bypass rate, subscription, usage, or access controls;
- automate abusive account creation, verification requests, support traffic, or promotional claims;
- use the Service to provide medical care or make decisions for another person; or
- reverse engineer or copy the Service except where applicable law does not permit us to restrict it.
We may investigate suspected misuse and restrict or suspend access when reasonably necessary to protect users, the Service, or third parties.
6. Subscriptions and payments
Some features require a paid Pro subscription. A subscription is an in-app digital service and is purchased through Apple's App Store or Google Play, depending on your device. The relevant store handles billing, renewal, cancellation, refunds, and payment-card information under its own terms and policies. CaloriePilot receives the subscription status and transaction information needed to provide and protect access; we do not store full payment-card details.
Unless the applicable store states otherwise, a subscription may renew automatically until you cancel it through the store. Account deletion does not cancel a store subscription. You must cancel before the store's renewal deadline to avoid a further charge. Mandatory consumer cancellation, refund, and statutory rights are not limited by these Terms.
When shown in the Service, CaloriePilot may offer one account-level seven-day Pro promotional trial. This is a backend promotional entitlement, not an Apple or Google store trial, does not require a payment method, does not automatically convert into a paid subscription, and normally cannot be claimed again after it has been used. Trial availability, eligibility, and duration may be limited or changed as permitted by law.
7. Intellectual property
The Service, including its software, design, names, logos, interfaces, databases, documentation, and content supplied by us, is owned by or licensed to CaloriePilot and is protected by applicable intellectual-property laws. Except for the limited right to use the Service under these Terms, we do not grant you ownership or other rights in it. You may not use CaloriePilot branding without our permission.
8. Third-party services
The Service may depend on or link to Apple, Google, authentication providers, payment and subscription providers, AI or OCR providers, hosting providers, or other third parties. Their services may have separate terms, fees, availability, and privacy practices. We are not responsible for a third party's independent service, and your use of it may be subject to that third party's agreement.
9. Availability and changes
We aim to keep the Service useful and available, but we do not promise that it will be uninterrupted, error-free, secure at all times, or available in every location or on every device. Maintenance, outages, provider failures, updates, and events outside our reasonable control may affect availability. We may release updates that you need to install to continue using the Service.
10. Suspension and termination
You may stop using the Service and request account deletion from Settings after reauthentication. We may suspend or terminate access if you materially breach these Terms, create risk or legal exposure, abuse the Service, fail to pay a required charge, or where necessary for security or legal compliance. We will use reasonable efforts to provide notice where appropriate, except when immediate action is required.
Account termination may make User Content and account access unavailable. The Privacy Policy describes deletion, backups, security records, subscription records, and other information that may remain for a limited period. Termination does not cancel an Apple App Store or Google Play subscription.
11. Disclaimers
To the maximum extent permitted by applicable law, the Service is provided on an "as is" and "as available" basis. We disclaim warranties that are not expressly stated in these Terms, including implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, and uninterrupted availability. Nothing in these Terms excludes a warranty or right that cannot lawfully be excluded.
12. Limitation of liability
To the maximum extent permitted by applicable law, CaloriePilot and its service providers will not be liable for indirect, incidental, special, consequential, or punitive loss, or for loss of data, profits, revenue, goodwill, or business arising from or related to the Service. To the extent liability cannot be excluded, it will be limited to the amount you paid to CaloriePilot for the Service during the twelve months before the event giving rise to the claim, or the minimum amount required by applicable law if greater. This section does not limit liability that cannot lawfully be limited, including liability for fraud, intentional misconduct, or certain personal-injury claims where applicable.
13. Applicable law and consumer rights
These Terms are interpreted under the law applicable to the relationship between you and the Service, without removing any mandatory consumer, privacy, or other rights that apply in your location. Nothing in these Terms prevents you from using a statutory complaint, regulator, or court process that cannot lawfully be waived.
14. Changes to these Terms
We may update these Terms when the Service, law, or our practices change. We will post the new version and update the date and version number. If a change is material, we will provide additional notice or request a new acceptance where required by law. Continued use after the effective date means the updated Terms apply to future use, subject to mandatory rights and any required acceptance.
